By accessing or using MailboxKit ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MailboxKit provides email infrastructure for AI agents, including:

Programmatic email sending and receiving via API.
Auto-provisioned email addresses for AI agents.
Custom domain support with DNS verification.
Webhook notifications for inbound email.
Email threading, attachment handling, and tracking.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. You are responsible for all activity under your account.

4. Acceptable Use

You agree not to use MailboxKit to:

Send unsolicited bulk email (spam).
Send phishing or fraudulent emails.
Distribute malware or harmful content.
Violate any applicable laws or regulations.
Impersonate individuals or organizations.
Harass, abuse, or threaten others.

We reserve the right to suspend or terminate accounts that violate these terms.

5. Pricing and Payment

MailboxKit uses pay-as-you-go pricing:

$0.002 per email sent or received.
$0.001 per attachment processed.
New accounts receive $1.00 in free credit.

Payments are processed by Stripe. You agree to pay for all usage incurred under your account. Credits are non-refundable once used.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We will make reasonable efforts to notify you of planned maintenance in advance.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of all email content processed through MailboxKit. We process your data only as necessary to provide the Service.

8. Intellectual Property

MailboxKit and its original content, features, and functionality are owned by MailboxKit and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

9. Limitation of Liability

To the maximum extent permitted by law, MailboxKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid to MailboxKit in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless MailboxKit from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

11. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease. We may retain your data for a reasonable period to comply with legal obligations.

12. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or notice on our website. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the State of Delaware.
